offers a SaaS platform for creating, hosting, and viewing Augmented Reality (AR) experiences for physical artworks via WebAR technology (browser-based), without requiring a mandatory app download for viewers.

2. ACCEPTANCE OF TERMS

By registering, accessing, or using our services (the "Platform", "Editor", or "WebAR Viewer"), you agree to be bound by these Terms. If you do not agree, please do not use our services.

Minimum Age: You must be at least 16 years old to register an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. ACCOUNTS AND SUBSCRIPTIONS

3.1. Account Types

  • Creator Account: For artists and galleries who wish to upload artworks and create AR layers.
  • Collector/Viewer: Generally does not require an account to view WebAR experiences, unless purchasing art or saving favorites.

3.2. Subscription Plans (SaaS)

operates primarily on a subscription model (e.g., Monthly or Annual plans).

  • Free Tier / Trial: May offer limited features (e.g., limited uploads or views) for testing purposes.
  • Pro / Premium Plans: Provide advanced features such as AI Editing tools, higher view limits, custom branding, and sales integration.
  • Founder Artist Grant: Special promotional plans (e.g., "6 months free") are subject to specific eligibility criteria and may revert to standard pricing upon expiration unless cancelled.

3.3. AI Credits

Some advanced features (like "AI Layer Separation" or "Generative Inpainting") may consume "Credits". These credits can be included in your subscription or purchased separately. Credits are non-refundable.

3.4. Payments and Renewals

  • Billing: Subscription fees are billed in advance.
  • Automatic Renewal: Your subscription automatically renews at the end of the applicable subscription period unless you cancel it before the renewal date.
  • Payment Processor: We use Stripe for secure payment processing. We do not store your credit card details.
  • Cancellation: You can cancel your subscription at any time from your dashboard. You will retain access until the end of your current billing period. No refunds are issued for partial months.

4. SELLING ARTWORK (COMMERCE)

allows creators to sell physical artworks or digital twins directly through the AR experience.

  • Commissions: may charge a transaction fee (commission) on sales made through our platform (e.g., 3-5%), in addition to standard payment processing fees charged by Stripe.
  • Responsibility: You (the Seller) are solely responsible for shipping, fulfillment, and customer service regarding the physical artwork. acts only as the technological intermediary for the transaction.
  • Disputes: Any dispute regarding the sale of physical art is between the Buyer and the Seller.

5. INTELLECTUAL PROPERTY & CONTENT

5.1. Your Ownership

You retain 100% ownership and copyright of the original artworks and digital assets you upload to . We do not claim ownership of your art.

5.2. License to

By uploading content, you grant a worldwide, non-exclusive, royalty-free license to:

  • Host, reproduce, and display your content solely for the purpose of providing the AR service (e.g., showing the AR video when a user scans your painting).
  • Use your content for marketing and promotional purposes (e.g., featuring your AR art on our social media or website as a "Featured Artist"), unless you explicitly opt-out in your account settings.

5.3. AI Processing License

If you use our AI tools (e.g., to segment your painting or generate animation layers), you authorize to process your image through our AI models. We do not use your private artworks to train public generative AI models without your explicit consent.

5.4. Prohibited Content

You may not upload content that:

  • Infringes on third-party copyrights (e.g., using a song you don't own rights to).
  • Is illegal, hateful, pornographic, or promotes violence.
  • Contains malware or malicious code. We reserve the right to remove any content and terminate accounts that violate these rules without prior notice.

6. DIGITAL PRESERVATION (LEGACY MODE)

If you have purchased a "Perpetual" or "Preservation" plan:

  • We commit to hosting the AR assets for the agreed duration.
  • In the event of ceasing operations, we will endeavor to provide a downloadable "Preservation Kit" or a static redirect to ensure your QR codes do not break, subject to technical feasibility.

7. DISCLAIMERS AND LIMITATION OF LIABILITY

7.1. "As Is" Service

is provided "as is". We do not guarantee that the WebAR service will work on every single device or browser, as this depends on third-party hardware and software updates (e.g., iOS or Android updates).

7.2. Liability

To the maximum extent permitted by law, Bernat Navacerrada Torras () shall not be liable for any indirect, incidental, or consequential damages (including loss of data, revenue, or profits) arising from your use of the service. Our total liability shall not exceed the amount you paid to us in the last 12 months.

8. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Spain. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

9. CHANGES TO TERMS

We may modify these Terms at any time. If we make material changes, we will notify you via email or a prominent notice on the Dashboard. Continued use of the service after changes constitutes acceptance.
